The App is a digital travel guide designed to provide information about tourist attractions, historical sites, and routes in Istanbul.

• "Company" (or "We", "Us", "Our") refers to Baris Yalcinkaya.
• "Service" refers to the App.
• "You" means the individual accessing or using the Service.

The App is provided for informational purposes only.

2. No Account Required

You do not need to create an account to use the App. However, certain features may require a valid subscription managed through your device's app store settings.

3. Intellectual Property

a. Our Content

All proprietary text, graphics, user interfaces, and code included in the App are owned by us and are protected by copyright laws.

b. Third-Party Assets

The App incorporates:

• Some images sourced from stock-photo platforms like Pexels, Unsplash, and Pixabay under their respective licenses.
• Animations from LottieFiles under their respective licenses.
• Map data provided by Mapbox.
• Device mockups created with MockUPhone.

c. Prohibited Conduct

You agree not to:

• Copy, modify, or create derivative works of the App.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use any automated system (robots, spiders, scrapers) to access the App.
• Use the App for any illegal or unauthorized purpose.

4. Affiliate Disclosure & External Links

a. Affiliate Disclosure (GetYourGuide)

The App contains affiliate links to tours provided by GetYourGuide. We receive a commission for qualifying purchases. We are not responsible for any issues arising from your booking.

b. External Links

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

c. Independent Business Recommendations

The App includes recommendations for various businesses such as restaurants, cafes, Turkish baths (hamams), and other local establishments. These recommendations are editorial in nature and are provided for informational purposes only. Apart from GetYourGuide, we have no commercial relationships with these businesses. All recommendations are independent and based on general popularity or tourist interest.

We do not guarantee the quality, safety, hygiene, or service standards of any recommended establishment. You should conduct your own research and verify current information before visiting any location.

5. Subscriptions

Subscriptions are handled via Adapty and processed by the Apple App Store or Google Play Store. Any refund requests or billing issues must be directed to the respective store support.

We reserve the right to modify subscription fees or features. Any price changes will take effect following notice to you, usually via the respective app store.

6. Disclaimer of Warranties ("AS IS" and "AS AVAILABLE")

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind.

a. Accuracy

We do not guarantee the accuracy, completeness, or timeliness of information (e.g., opening hours, ticket prices). You should verify critical information directly with the venue.

b. Availability

We are not responsible if a location is closed, under renovation, or no longer exists.

7. Limitation of Liability

To the fullest extent permitted by law, the Company shall NOT be liable for:

• Personal Injury: Any illness (e.g., food poisoning), injury, or accident at any location recommended.
• Service Quality: Dissatisfaction with any venue or tour.
• Indirect Damages: Loss of profits, data, or other intangible losses resulting from your use of the App.
• Third-Party Actions: Acts or omissions of third parties (e.g., tour guides, other tourists).

Our liability is limited to the amount actually paid by You through the Service, or 100 USD if You haven't purchased anything.

8. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how data is processed when you use maps, subscriptions, and affiliate content.

9. Governing Law

The laws of Republic of Türkiye, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

10. Dispute Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

11. For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

12. United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
